1. Introduction

These Terms and Conditions ("Terms") govern your use of the Constellation Apartments website located at www.constellationsliving.com (the "Site") and all reservation enquiries, confirmed bookings, and stays at Constellation Apartments, Ternan Avenue, Nakasero, Kampala, Uganda (the "Property").

By accessing our Site, submitting a reservation enquiry, or staying at our Property, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use our Site or submit a reservation request.

Constellation Apartments is managed by Constellation Hospitality in association with Sheraton Kampala Hotel.

2. Website Use

2.1 Permitted Use

www.constellationsliving.com is provided for informational and reservation enquiry purposes only. You may use this Site to browse apartment information, view rates, submit reservation enquiry forms, and contact our team.

2.2 Prohibited Use

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose

  • Attempt to gain unauthorised access to any part of the Site or its underlying systems

  • Reproduce, copy, distribute, or commercially exploit any content, images, or materials from this Site without prior written consent from Constellation Apartments

  • Submit false, misleading, or fraudulent reservation enquiries

  • Use automated tools, bots, or scrapers to extract data from this Site

2.3 Intellectual Property

All content on www.constellationsliving.com, including but not limited to text, images, logos, design elements, and branding, is the intellectual property of Constellation Apartments and/or Constellation Hospitality. The Constellation Apartments name, logo, and gold "C" monogram are protected marks. Unauthorised use is strictly prohibited.

2.4 Website Availability

We strive to maintain uninterrupted access to www.constellationsliving.com but do not guarantee that the Site will be available at all times. We reserve the right to suspend, modify, or discontinue the Site at any time without notice and shall not be liable for any resulting loss or inconvenience.

3. Reservation Enquiries

3.1 Enquiry Process

Submitting a reservation enquiry form on www.constellationsliving.com does not constitute a confirmed booking. Your preferred dates are not held or guaranteed until you receive a written confirmation from our reservations team at frontoffice@sheratonkampala.com.

3.2 Acceptance of Reservations

Constellation Apartments reserves the right to decline any reservation request without providing a reason. We are not obligated to confirm availability or accept any enquiry.

3.3 Accurate Information

You are responsible for ensuring all information submitted in reservation enquiry forms is accurate and complete. Constellation Apartments shall not be liable for any issues arising from inaccurate information provided by the guest, including incorrect dates, contact details, or guest count.

4. Check-In & Check-Out

  • Standard Check-In Time: 2:00 PM East Africa Time (EAT)

  • Standard Check-Out Time: 11:00 AM East Africa Time (EAT)

  • Early Check-In: Subject to availability and may incur an additional half-day charge

  • Late Check-Out: Subject to availability and may incur an additional charge of up to 50% of the nightly rate

  • A valid government-issued photo ID or passport is required for all guests at check-in

  • All guests occupying the apartment must be registered at check-in

5. Minimum & Maximum Stay

  • Minimum stay: 7 nights (1 weeks)

  • Maximum stay: 365 nights (1 year)

  • Stays of 30 nights or more are subject to a separate Long-Stay Rental Agreement, which will be issued prior to check-in and must be signed by both parties before occupation

6. Payment Terms

All payments are due in full at check-in. We accept cash (USD or UGX) and debit/credit cards via POS terminal on-site. No payments are processed through our website. Rates quoted are per night, per week, or per month as indicated, and are subject to availability and seasonality. All confirmed rates will be communicated in writing before check-in. Rates include applicable taxes unless otherwise stated.

7. Guest Responsibilities & Property Rules

7.1 General Conduct

Guests are expected to behave respectfully toward other residents, property staff, and the surrounding community at all times.

7.2 Apartment Care

Guests are responsible for:

  • Keeping the apartment clean and in good condition throughout the stay

  • Reporting any damage, maintenance issues, or malfunctions to the management team promptly

  • Ensuring apartment doors and windows are securely locked when not in the unit

7.3 Occupancy

The maximum number of guests per apartment must not be exceeded:

  • One Bedroom: Maximum 2 guests

  • Two Bedroom: Maximum 4 guests

  • Three Bedroom: Maximum 6 guests

Unauthorised additional occupants may result in immediate termination of the stay without refund.

7.4 No Smoking

Smoking is strictly prohibited inside all apartments and common areas of the property. Designated outdoor smoking areas may be available. Violation of this policy will result in a cleaning surcharge deducted from the security deposit.

7.5 Pets

Pets are not permitted on the property unless expressly agreed in writing by Constellation Apartments management prior to check-in.

7.6 Noise & Disturbance

Guests must observe reasonable quiet hours between 10:00 PM and 7:00 AM EAT. Parties, loud gatherings, and disturbances that affect other residents are strictly prohibited.

7.7 Visitors

Overnight visitors who are not registered guests are not permitted without prior written approval from management.

8. Housekeeping & Maintenance

Standard housekeeping services are provided as part of the serviced apartment package. Frequency of housekeeping visits will be communicated at check-in. Maintenance requests should be submitted to frontoffice@sheratonkampala.com or reported directly to the front desk. We commit to addressing urgent maintenance issues within 24 hours and non-urgent requests within 72 hours.

9. Sheraton Kampala Hotel Facilities

Access to Sheraton Kampala Hotel's amenities—including the swimming pool, fitness centre, spa, restaurants, bars, business centre, and conference facilities—is provided as a privilege to Constellation Apartments residents, subject to:

  • Sheraton Kampala Hotel's own terms and conditions

  • Facility availability and operating hours

  • Any applicable charges for specific services (e.g., spa treatments, dining)

Constellation Apartments does not guarantee uninterrupted access to Sheraton facilities and shall not be liable for any disruption, restriction, or unavailability of those services.

10. Liability & Disclaimers

10.1 Property Liability

Constellation Apartments shall not be liable for:

  • Loss, theft, or damage to personal belongings of guests within the apartments or common areas

  • Personal injury on the property resulting from guest negligence or failure to follow safety guidelines

  • Disruption of utility services (electricity, water, internet) caused by third-party providers or national infrastructure issues

10.2 Website Disclaimer

The information on www.constellationsliving.com is provided in good faith and for general informational purposes only. While we strive for accuracy, we make no warranties regarding the completeness or accuracy of the content. Images on the Site are for illustrative purposes and actual apartment appearances may vary slightly.

10.3 Limitation of Liability

To the maximum extent permitted by Ugandan law, Constellation Apartments' total liability to any guest shall not exceed the total amount paid by that guest for the stay in question.

11. Force Majeure

Constellation Apartments shall not be liable for any failure or delay in fulfilling its obligations under these Terms where such failure arises from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government action, civil unrest, pandemic restrictions, or utility failures.

12. Termination of Stay

Constellation Apartments reserves the right to terminate a guest's stay immediately and without refund in the event of:

  • Serious violation of these Terms or Property Rules

  • Threatening, abusive, or violent behaviour toward staff or other residents

  • Criminal activity or suspicion thereof

  • Unauthorised subletting or commercial use of the apartment

In such cases, the guest will be required to vacate the premises immediately, and the security deposit may be withheld in full.

13. Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes arising out of or in connection with these Terms, the use of our website, or a stay at the property shall be subject to the exclusive jurisdiction of the courts of Kampala, Uganda.

Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation. Formal complaints may be submitted in writing to frontoffice@sheratonkampala.com.

14. Amendments

Constellation Apartments reserves the right to update, modify, or replace these Terms and Conditions at any time. Updated Terms will be published on www.constellationsliving.com with a revised effective date. Continued use of the Site or the Property following any amendments constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be severed from the remainder of these Terms, which shall continue in full force and effect.
